I skimmed trough the code and found out that it depend on FMOD. Es far es I know there was never source available only pre compiled binaries. I knew that you could use a smaller version with only the tracker routines for demos for free under DOS. However with some open source licences that could cause Problems. For example it would always count as unfree in the Debian-Project. Best would be to separate the parts that require closed stuff into a optional module.
